How is child support determined?

Child support can be a significant concern for divorcing parents which is why they should understand the child support process in Maryland. Knowing how child support is calculated can help both paying and recipient parents resolve their child support concerns and ensure the child is properly cared for.

All children in Maryland have the right to receive support from their parents and be financially cared for by their parents. Child support is intended for the support of the child and is calculated in Maryland based on child support guidelines. Parents are free to develop their own child support agreement as long as it is close to what state guidelines would provide for but the family law system is also available to help them develop a child support agreement if they are unable to do so for themselves.

Factors that are considered when determining child support include the combined adjusted actual income of both parents which includes potential income if one parent is unemployed. Utilizing the combined adjusted actual income of the parents, the child support obligation will be determined. The custody arrangement the parents have may also be considered. Included in the child support order are educational expenses, childcare expenses, health insurance coverage, medical expenses and travel expenses.

Once a child support order has been developed, parents may have enforcement concerns as well as modification concerns which the family law system can help them with. Before that, of course, it is important for divorcing parents to be familiar with how they can seek and receive child support which the family law process can also help them with.
