What Maryland residents should know about marijuana paraphernalia

It is common knowledge that some lawmakers in our nation have recently relaxed their views about the use and possession of marijuana. However, possession of drug paraphernalia related to marijuana could still land you in hot water. To put it in simple terms, you should understand that the new stance on marijuana does not mean the laws regarding this substance have simply disappeared.

Marijuana paraphernalia is still largely a gray area in the eyes of the law. As such, people who use marijuana for recreational purposes are advised not to look at paraphernalia as a non-issue. Common examples of paraphernalia related to marijuana use include bongs, pipes and roach clips. Paraphernalia items related to distribution and cultivation include scales, plastic bags and some gardening supplies.

Residents of Maryland who are caught with paraphernalia in their possession could face drug charges. In most cases, the charges will be classified as misdemeanors, but a conviction may mean costly penalties ranging from a $500.00 fine for a first offense up to incarceration and a $2,000.00 fine for subsequent offenses. If a defendant is convicted of delivering paraphernalia to a minor, the penalty could be eight years in prison and a $15,000.00 fine.

In Clinton and Dunkirk, our firm has seen many unsuspecting residents face drug charges related to paraphernalia. When we are asked for advice about these charges, we routinely advise defendants to acquire representation from a defense attorney with the skill to investigate the alleged crime. We urge you to learn more about the state laws governing marijuana paraphernalia possession by reaching out to our firm. You can also find additional information on our website.
